CODE OF PRACTICE

Members of the Alberta Construction Association agree that, for construction work which is to be carried out on a competitive basis using complete working plans and specifications, the following provisions shall govern:

  1. Work is to be carried out by qualified tradesmen to the quality and standards specified.

  2. A contractor shall use tenders only from qualified subcontractors.

  3. A bidder shall neither seek nor accept information concerning a competitor's bid prior to the opening of tenders.

  4. A bidder shall never make known the tender of any subbidder to any subbidder before the closing of tenders; and shall never use the tender of a subbidder in order to secure a lower proposal from another subbidder.

  5. Subcontractors shall be advised as soon as is reasonable after bid closing as to whether or not their bid was used in the making up of a successful prime contractor's bid; subtrade contracts should be awarded with the utmost possible dispatch.

  6. A contractor should award each subcontract to the qualified subcontractor tendering the lowest price; if the award is made to any other subcontractor, it shall be at the latter's tendered price.

  7. A contractor shall pay all subcontractors and suppliers, promptly and in accordance with the terms of the contract for their contracted work.

  8. All services performed by one contractor for another where payment is required should be recorded and signed for at agreed intervals; agreement with regard to the payment for such job services should be reached and recorded in writing before such work commences.

  9. The Alberta Construction Association Standard Subcontract Form or applicable CCA document should be used.
